Applicants
Where the applicant is a legal entity (e.g. a company) the full legal name of the company should be entered in the 'name' field. The country in which the company is incorporated may be entered in the 'nationality' field. This field is optional and the information is used only for statistical purposes.
Legal Representative
This can be a Trade Mark Agent, a Solicitor, a Barrister or a person qualified to act on behalf of another who is qualified to act before their National Intellectual Property Office within the European Community.
Correspondence Address
The provision of a correspondence address in the EEA is a legal requirement provided by Rule 4 of the Trade Marks (Amendment) Rules 2010 amending Rule 10 of the Trade Mark Rules, 1996.
The correspondence address may be that of the applicant's legal representative based within the European Community. The correspondence address is the address to which all correspondence concerning the application will be sent.
Trade mark information
This may be a word (Word mark) and/or a picture (Figurative mark). If the mark consists of a word(s) in plain type, select 'Word Mark', if the mark consists of word(s) using a particular style or graphical feature or a combination of word(s) and graphical features select 'Figurative Mark'.
A Trade Mark can be something other than a word/picture but must be capable of being represented graphically. You must provide a copy of your Mark. The Office will only accept images in JPEG format limited to 4Mb in size.

A word mark may only have a verbal element.
A figurative only mark consists of a picture, logo, icon or image. It must not include any text.
A figurative mark containing word elements combines the use of pictures, graphics or images with words or letters.
A three-dimensional mark is represented using a three-dimensional shape, such as the actual product or its packaging.
A colour per se mark is used only to register an actual colour to distinguish products or services.
A sound mark must be represented graphically using, for example, musical notation (score music).
A three-dimensional mark containing words combines the use of a three dimensional shape with words.
This is a new category of trade mark (as and from 1 October 2017). Hologram marks consist of elements with holographic characteristics.
A position mark consists of the specific way in which the mark is placed or affixed to the product.
A trade mark consisting of, or extends to, a movement or a change in the position of the elements of a mark.
It consists, or extends to, the combination of images and sound.
A pattern mark consists exclusively of a set of elements which are repeated regularly.
Claim to a Right Of Priority (optional)
If you wish to claim the priority of an earlier application for the same mark (and with some or all of the same goods/services) made outside Ireland within the last 6 months you must indicate the priority country, the date of filing of the earlier application and the number allocated to the earlier application.
The Patents Office will accept a PDF of the priority certificate issued by the competent national authority. You can either submit this PDF at the time of application or send at a later stage. Documents in other formats will not be accepted.

Goods and services
You must indicate the goods and/or services for which you wish to have your trade mark registered. The Irish Patents Office uses an international classification system called the Nice Classification. This splits all goods and services into 45 separate classes. An application can be made in respect of one or more classes. The application fee to register a trade mark is €70 and includes the first class. For each class over one there is a fee of €70 per class. You can indicate your goods/services by either searching TMClass (Search) or providing your own list of goods/services.
You should think carefully before deciding on what goods and services you want to protect with your trade mark registration. The classification system for goods and services is designed in a way that it helps you decide on the correct protection for your trade mark(s), simplifying the registration process, while at the same time giving the consumer the choice they need.

Declaration
An applicant for the registration of a trade mark must make a declaration that the trade mark is being used by the applicant or with the consent of the applicant, in relation to all of the goods or services specified, or that there is a bona fide intention that it will be so used. You must "sign" the electronic application form before final submission by indicating the applicant full name, and if the applicant is a company, state the position within the company of the person signing.
